Terms of Use

These Terms of Use ("Terms") are an agreement between you and Akash Mangukiya ("we", "us") for the Live Earth Map & Street Cam HD app ("the app"). By downloading or using the app you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the app.

1. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app on Apple-branded devices that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. You may not copy, modify, reverse engineer, resell, rent or redistribute the app, except as the law expressly allows.

2. Premium subscription

• Premium Weekly removes ads and unlocks PRO features such as the speedometer and priority support. It costs US$4.99 per week (or the equivalent price shown in the App Store for your country), with no free trial.
• Payment is charged to your Apple Account when you confirm the purchase.
• The subscription renews automatically every week at the same price unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for renewal within the 24 hours before the current period ends.
• You can manage or cancel the subscription in your App Store account settings (Settings → your name → Subscriptions), or from Settings → Manage subscription in the app. Cancelling stops the next renewal; you keep Premium until the end of the paid period.
• Refunds are handled by Apple under its policies; request one at reportaproblem.apple.com.
• If you reinstall the app or use a new device with the same Apple Account, use "Restore purchases" to get Premium back.
• Watching a rewarded video to use a PRO tool once gives a single use only and is not a subscription.

3. Safe and lawful use

• Do not use the app while driving in a way that distracts you. Set up the speedometer or navigation before you set off, and always follow road signs, traffic laws and posted speed limits.
• Speed, distance, altitude, compass, level, air pressure and oxygen readings are estimates from your device's sensors and online data. They can be inaccurate and must not be relied on for safety-critical, navigational, medical, legal or professional purposes. The Oxygen Level feature is not a medical device and does not measure the oxygen in your blood.
• When you take GPS Cam photos, respect other people's privacy and the law where you are.
• You agree not to misuse the app, interfere with its operation or the services it uses, or use it for any unlawful purpose.

4. Third-party content and services

Live cameras are public live streams published on YouTube by third parties. We do not own, control or endorse them, cannot guarantee that any stream is available, accurate or appropriate, and may add or remove cameras at any time. Your use of YouTube content is also subject to the YouTube Terms of Service. Maps, satellite imagery, Look Around and place data are provided by Apple; weather and elevation data by Open-Meteo. These services may change or stop working outside our control.

5. Advertising

The free version of the app shows ads provided by Google AdMob, as described in the Privacy Policy. We are not responsible for the content of third-party ads or the products they promote.

6. Intellectual property

The app, its design, text, graphics and software are owned by us or our licensors and are protected by law. Country flags are from the open-source flag-icons project (MIT licence). Third-party names and trademarks belong to their owners.

7. Disclaimer of warranties

To the maximum extent permitted by law, the app is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, and uninterrupted or error-free operation.

8. Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or opportunities, arising from your use of or inability to use the app. Our total liability for any claim relating to the app is limited to the amount you paid for the app or subscription in the three months before the claim. Nothing in these Terms limits liability that cannot be limited under applicable law, or your statutory rights as a consumer.

9. Changes and termination

We may update the app and these Terms. If we make significant changes to the Terms, we will update the effective date above and tell you in the app; continuing to use the app after that means you accept the updated Terms. Your licence ends automatically if you breach these Terms. You may stop using the app at any time by deleting it.

10. Apple-specific terms

• These Terms are between you and us only, not with Apple Inc. ("Apple"). We, not Apple, are solely responsible for the app and its content.
• Apple has no obligation to provide any maintenance or support services for the app.
• If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
• We, not Apple, are responsible for addressing any claims by you or a third party relating to the app or your possession or use of it, including product liability claims, claims that the app fails to conform to any legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
• If a third party claims that the app or your possession and use of it infringes their intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement and discharge of that claim.
• You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• You must comply with applicable third-party terms (for example, your mobile carrier's terms) when using the app.
• Apple and its subsidiaries are third-party beneficiaries of these Terms, and once you accept them, Apple has the right to enforce them against you as a third-party beneficiary.

11. Governing law

These Terms are governed by the laws of India. This does not take away any mandatory consumer protection rights you have under the law of the country where you live.
